Washington policymakers just announced a plan to gut the 1980 Bayh-Dole Act, the bipartisan law that underpins American innovation.
Thanks to Bayh-Dole, universities and small businesses own the patent rights on the discoveries they make with federal support. The law’s impact is impossible to overstate. Along with Google search, TV and WiFi technologies, and even tasty foods, the law has helped create numerous life-saving medicines.
A new proposal would upend this law by putting Washington in the driver’s seat of technology management, empowering bureaucrats to forcibly relicense patents if they object to a product’s price. If finalized, Consumers could lose out on thousands of life-changing technologies.
There is strong bipartisan support in Congress to reverse this proposal.
